請問The Appellate Division, by a divided court該怎麼翻？另外Supreme Court不是最高法院嗎？為何文中說reversed the judgment of the Supreme Court？

一、請問The Appellate Division, by a divided court該怎麼翻？

The Appellate Division，是第二審上訴法院。

by a divided court，是指合議庭法院並未達成一致意見，是分裂的法院意見，有作為判決的多數意見書，亦有法官提出不同意見書，或協同意見書。

二、另外Supreme Court不是最高法院嗎？為何文中說reversed the judgment of the Supreme Court？

美國法院分為州法院系統及聯邦法院系統，雖然一般認為州法院系統的第一審地方法院多半翻為District Court，但亦有許多州的第一審地方法院名稱就是Supreme Court，例如紐約州、紐澤西州等。

因此第二審上訴法院自有權駁回下級審的判決。
